What Is Mubarat?

In Islamic law, Mubarat is a form of divorce by mutual consent where both the husband and wife agree that the marriage is no longer tenable and wish to separate peacefully. The word itself means mutual release.

Unlike other forms of divorce under Muslim Personal Law, Mubarat does not require one party to allege fault against the other. It is bilateral, dignified, and finalised through a written deed called the Mubarat Nama, executed before a notary with two witnesses present.

Mubarat applies where both spouses are Muslim, and also where only one spouse is Muslim but the marriage was solemnised under Muslim Marriage law, including a Nikah registered under the Muslim Personal Law (Shariat) Application Act.
